1. Agreement to Terms

By accessing or using OmniGreet's services, website, or platform (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

OmniGreet is operated by OmniGreet AI, Inc. (“we,” “us,” or “our”). These Terms apply to all visitors, users, and clients of the Service.

2. Accounts

When you create an account, you must provide accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

You must notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.

3. Description of Service

OmniGreet provides AI-powered voice receptionist services for businesses. Our platform answers inbound calls, handles customer inquiries, books appointments, takes messages, and transfers calls on behalf of our clients.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

4. Subscriptions and Billing

Access to certain features requires a paid subscription. By subscribing, you agree to pay the applicable fees as described on our Pricing page. Subscriptions automatically renew unless cancelled before the renewal date.

  • All fees are billed in advance on a monthly basis.
  • Overage charges for usage beyond your plan's included minutes are billed at the end of each billing cycle.
  • Refunds are handled on a case-by-case basis. Contact support for refund requests.
  • We reserve the right to change pricing with 30 days' notice.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Transmit spam, unsolicited communications, or fraudulent content through AI calls.
  • Impersonate another person or entity.
  • Interfere with the operation of the Service or attempt to gain unauthorized access.
  • Use the Service for illegal robocalling, telemarketing fraud, or harassment.
  • Reverse engineer, decompile, or disassemble the Service.

6. Intellectual Property

The Service, including its design, features, code, and content, is owned by OmniGreet AI, Inc. and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without prior written consent.

You retain ownership of any data, content, or information you provide to the Service (“Your Content”). By using the Service, you grant us a limited license to use Your Content solely to provide and improve the Service.

7. Call Recording and Data

Our Service may record, transcribe, and store calls made through our AI receptionist. By using the Service, you acknowledge and consent to this recording. You are responsible for ensuring that your callers are informed of and consent to recording in accordance with applicable laws.

We process call data in accordance with our Privacy Policy. Call recordings are stored securely and retained for the duration specified in your plan.

8. Third-Party Integrations

The Service may integrate with third-party platforms (e.g., calendar systems, POS, CRM). We are not responsible for the availability, accuracy, or security of third-party services. Your use of third-party integrations is subject to their respective terms and conditions.

9. Limitation of Liability

To the maximum extent permitted by law, OmniGreet AI, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless OmniGreet AI, Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

12. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may cancel your subscription at any time through your account settings.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be resolved in the courts of Delaware.

14. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
